SERVICES PROVIDED:
Development approval for the partially constructed apartment building had lapsed. Ross Heatley recommended solicitors be appointed to seek revival of the approval in Court – which was successful. Ross Heatley obtained development approval to replace some apartments with commercial elements – restaurant/bar, conference facilities and day spa.
OUTCOME:
Overcoming strong opposition from Council planning staff, two actions were taken simultaneously:
- action in the Planning and Environment Court to revive the development approval for the apartments; and
- application for Material change of Use (Impact) to modify that approval so as to include commercial elements.
Ross Heatley sourced and supported the legal team for the first action.
Ross Heatley, with the support of project architect PAC Cairns, presented a comprehensive development application, overcame an onerous information request, advertised the proposal (with no objections) and obtained development approval.
Post-approval, Ross Heatley ensured sign-off by Council to all conditions to allow progress to building certification stage.
