SERVICES PROVIDED:
Ross Heatley had previously obtained approval for a second detached dwelling to be built on the larger than usual (1093m2) site. The client advised that after some time she found she was not able to build and sell a new dwelling.
Client identified to Ross Heatley that she would prefer to subdivide the lot into two – with the existing dwelling to remain on one lot.
Ross Heatley established that a Material Change of Use (Impact) was required.
It was noted that the zoning controls allowed residential density to as low as 1 dwelling per 400m2 – but the subdivision controls mandated lot sizes of no less than 600m2.

The application received no objections and was approved – subject to a condition that a small portion of the roof corner of exiting dwelling be modified so as to not encroach into access way for proposed new lot (see diagram above).
Subsequently the planning scheme was amended to allow small lot housing in this zone.
