SERVICES PROVIDED:

The client had filled a low lying part of the site without seeking approval. A ‘show cause’ notice was issued.

Working in association with hydraulic engineers, Max Winders and Associates, Ross Heatley added geotechnical engineers to retrospectively identify site stability of the recently filled area.

Max Winders provided an assessment of the fill on the local flood catchment area and confirmed no upstream effect.

Ross Heatley applied for Operational Works (Change to Ground Level). Council had great difficulty in determining the appropriate referral agencies. Several agencies were included but advised they had no interest.

Then Council stated that the applicant must remove the flood gates which prevented seawater entry to the site and local area. This would have resulted in severe flooding at any high tide event. The flood gates had been installed more than 50 years previously.

Council eventually approved the development application. The application was lodged on 24/10/2016 and approved on 14/3/2017.
